Lomto · Legal
Terms, Conditions
& Privacy Policy
Effective date: 20.03.2026 · Governed by Czech law & EU consumer directives
01
General Provisions
These Terms and Conditions govern the mutual rights and obligations arising in connection with or pursuant to a purchase contract concluded between Šimon Husák, a sole trader (OSVC), having its registered office at Mostek 120, 544 75, Mostek, Czech Republic, Identification Number (ICO): 24859648, registered in the Trade Register, email address: info@lomto.eu as the seller, and a consumer as the buyer, through the online store operated at https://lomto.eu. The legal relations not expressly defined herein are governed by the laws of the Czech Republic, primarily Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, conforming to EU directives including the Consumer Rights Directive 2011/83/EU, the E-Commerce Directive 2000/31/EC, Directive 2019/771 on the sale of goods, and the Omnibus Directive 2019/2161.
02
Service Definition and Dropshipping Model
The online store operates on a dropshipping logistics model. The seller accepts the order, concludes the purchase contract with the buyer, and processes the payment. The physical goods are subsequently sourced from and dispatched directly to the buyer by third-party suppliers. Despite this logistical arrangement, the contractual relationship exists solely between the buyer and the seller. The seller remains fully and exclusively legally responsible towards the buyer for the delivery of the goods, conformity of the goods with the contract, handling of consumer withdrawals, and warranty claims.
03
Order Creation and Contract Conclusion
The presentation of goods on the website is of an informative nature and does not constitute a legally binding offer to conclude a contract under Section 1732(2) of the Civil Code. The buyer creates an order by filling out the order form on the website, which includes providing delivery and payment details. Before submitting the binding order, the buyer is allowed to check, modify, and correct the input data. The purchase contract is officially concluded at the moment the seller sends the order confirmation to the buyer via the provided email address.
04
Pricing, VAT, and Payment Terms
All prices of goods displayed on the website are final and include all related statutory fees. If the seller is a VAT payer, the prices include the applicable statutory Value Added Tax. Any delivery costs are stated separately during the checkout process before the order is finalized. The buyer may pay the purchase price and delivery costs via online payment card or standard payment gateways integrated into the website. The seller requires the full settlement of the order value prior to the dispatch of the goods.
05
Delivery Conditions and Transfer of Risk
Due to the dropshipping nature of the business, goods are shipped directly from the seller's third-party suppliers or logistics partners to the buyer's designated address across the European Union. Delivery times stated on the website are estimated based on supplier logistics. The seller is liable for ensuring the delivery is made without undue delay, no later than 60 days from the conclusion of the contract unless a longer delivery time was explicitly agreed upon. The risk of damage or loss of the goods transfers to the buyer upon physical receipt of the goods by the buyer or a third party designated by the buyer.
06
Consumer Right of Withdrawal
A buyer who is a consumer has the right to withdraw from the contract without giving any reason within a cooling-off period of 14 days from the day of physical receipt of the goods. To exercise this right, the buyer must inform the seller via an unambiguous statement sent to info@lomto.eu. The buyer must return the goods to Mostek 120, 544 75, Mostek, Czech Republic without undue delay and no later than 14 days from the date of withdrawal. The direct cost of returning the goods is borne entirely by the buyer. The seller shall refund all payments received from the buyer, including standard delivery costs, within 14 days of receiving the returned goods or verifiable proof of their return shipment.
07
Complaint and Warranty Policy
The seller is liable to the buyer that the goods are free from defects upon receipt. The buyer may assert rights from defective performance within 24 months from the receipt of the physical goods. In the event of a defect, the buyer has the right to demand repair, replacement, a reasonable discount, or to withdraw from the contract if the defect constitutes a material breach. Complaints must be submitted in writing to info@lomto.eu or sent physically to Mostek 120, 544 75, Mostek, Czech Republic. The seller will issue a written confirmation of the complaint and will process and resolve the complaint, including the rectification of the defect, within 30 days of its receipt.
08
Liability and Force Majeure
The seller is not liable for delays or failures in performance resulting from acts beyond their reasonable control, including but not limited to severe natural disasters, systemic customs delays, or major global logistical disruptions, provided the buyer is promptly informed of such delays. Liability for damages is limited to the extent permitted by mandatory consumer protection laws.
09
Intellectual Property
All content displayed on the website, including product descriptions, photographs, code, and logos, is the intellectual property of the seller, their suppliers, or licensors and is protected by applicable copyright and trademark laws.
10
Governing Law and Dispute Resolution
These terms and the underlying purchase contract are governed by the laws of the Czech Republic. This choice of law does not deprive the consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the consumer's habitual residence within the EU. In the event of a consumer dispute, the buyer may contact the Czech Trade Inspection Authority at www.coi.cz for out-of-court resolution. Consumers may also utilize the EU Online Dispute Resolution platform available at http://ec.europa.eu/consumers/odr.
11
Final Provisions
If any provision of these Terms and Conditions is or becomes invalid or legally ineffective, it shall be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity of one provision shall not affect the validity of the remaining provisions. These Terms and Conditions take effect on 20.03.2026.
